What does one do when he/she is served with a Court Summon(s)?
After the plaint has been filed, summons are issued by the court to be served upon(delivery)to the other party requiring a party(Defendant).
A Summons is a written order signed and sealed by a court, requiring a party to appear in court.
The summons requires the defendant to file a defence for a given period of time from the day the summons is received.
If the defendant does not reply to the Summons, the suit can be heard and decided without the defendant.
Summons must be delivered to the defendant within 21days of issue by court.
If they are not delivered within that period, the plaint must apply for extension of the period within which to serve the summons.
If no such application is made the case will be dismissed from court.
